Real-ID Resistance in New Hampshire: Alive and Kicking!
As you may have heard, there is good news and bad news about HB1582, which would "opt out" New Hampshire from the Federal "Real-ID" act.
The Good news is, HB 1582 passed the Senate.
The Bad News is, NH Senator Barnes watered the bill down with an amendment, which then passed. Needless to say, Mr. Barnes has not made many friends with this move; indeed, he has acquired many adversaries. It would appear that Federal lobbyists and politicians -- including Judd Gregg, our own State Senator, applied strong-arm tactics to the entire New Hampshire Senate, and Barnes was the one who broke.
At the moment, there are 3 fronts in this battle:
1. HB 1582: Watered-Down? What Does That Mean, Exactly?
In essence, the Senate decided to defer any decision for a few months. The new, amended bill simply forms a "Study Committee". This committee would submit its finding by November 1, 2006.
Since the Senate changed the wording of the bill, it now heads to a "Committee of Conference": a small group of folks from the House of Representatives and from the Senate, who must come to a compromise on the final wording of the bill. If they can come to an agreement, then that agreement goes to the Governor's desk, where it will very likely be signed.
If the Committee of Conference cannot come to an agreement, the bill dies, and this particular battle-front is lost.
An agreement is quite likely. It's hard to speculate on what that agreement might be; most likely, the House will try to influence the composition of the Study Committee, to try and ensure that it contains people who oppose Real-ID.
2. The Money and the Catch
The Federal Government is offering New Hampshire 3 million dollars, to be used in implementing Real-ID. If we take the money, we have probably committed to real-ID, no matter what!
The money would first be accepted by the Fiscal Committee.
It would then need to be approved by the Governor's Executive Council.
The Fiscal Committee met this morning (Friday, May 5). Present were myself, and Jenn Coffey from the Second Amendment Sisters, another group opposed to Real-ID, both sporting prominent "No Real-ID!" badges donated by none other than Friday Jones of the Free State Observer. The $3mil was the very first agenda item of the day, and it took less than 1 minute for the Committee to "table it", which means they have put off making any decision about the money until at least the next committee meeting. Ah yes, the standard pattern of politics anywhere: when a tough decision has to be made, avoid doing so until later!
At any rate, we will be watching the Fiscal Commitee and the Executive Council closely.
3. SB 399: The "other" Anti-Real-ID Act!
News Flash!The late-breaking good news is, the entire text of the original bill has also been introduced to another bill, SB 399.
That bill is a beauty in its own right. Colloquially was known as the "anti-FEMA bill", in that it would specifically have the State of New Hampshire handle the duties typically handled by the Federal Emergency Management Agency (FEMA). You may recall how poorly FEMA did its job during Hurricane Katrina. Since New Hampshire would itself be taking care of these responsibilities, the Federal agency would not be in a position to do so. This follows the Libertarian notion of local control being preferable to central control -- more accountability. A very good bill!
But now, of course, the bill is even more beautiful, as it was Amended in the House. And the Amendment is -- get this -- the entire, unmodified core text of the original "anti-Real-ID" bill, HB1582!
As such, there will now be a "Committee of Conference" formed for SB 399. Just like the one for HB 1582, the Committee must agree on the final wording of the bill. Such Committees typically have 7 members: 4 appointed by the Speaker of the House, and 3 by the President of the Senate. Anything can happen!
Next Steps
The coalition of organizations opposing Real-ID in New Hampshire continues to push on all three fronts noted above. We are keeping an eye on every public official and committee meeting. With the public officials, we're bending ears and making our opinions known. With the committees, we're making ourselves visible at every meeting, so there can be no chance of any actions done "away from the public eye."
Those folks in Washington who so desperately want Real-ID are betting that the people of the Free State of New Hampshire will simply forget.

I see that on May 24, 2007 New Hampshire did pass a bill against Real ID. Good on you! Some other states have done it too, I don't see how the program can go into use in 2009.
Real ID in NH
I haven't found any news about this more recent than last spring. Has NH decided anything? Has the committee that studied the issue put out any result?
There is a movement for freedom loving people to move to NH, but I want to make sure the state really will stand up for the constitution before I think about moving there.

I am 99% certain we will REJECT Real-ID in this state within the next 12 months. The bill to do so has already been submitted, and the new session has not even started yet.

I was raised in Maine, have been living in the south for 10 years now, and recently had been in the beginning stages of moving back to the Northeast. New Hampshire had made the boyfriend's and my "short list". After the Real ID Act passed, I was thinking I might end up leaving the country altogether; it is great to know NH might be an option for me (us)!
